Article 4
Cultural actions

Sub-article 1: Education and research

The regional council shall determine, after receiving the opinion of the council of culture, education and environment, the complementary educational and cultural activities regarding the knowledge of the regional languages and cultures, which may be organised in the schools under the competence of the region.

These activities, which may take place during the opening hours of the involved centres, are facultative and neither may be substituted nor may discriminate against the educational and teaching programmes defined by the State.

These activities shall be financed by the region. The organisation as well as the functioning of these activities shall be defined by conventions concluded among the region, the collective in charge of managing the centre, the person responsible for the centre and, where appropriate, the association or body which provides the service.

The rest of complementary educational, sport and cultural activities may be also organised by the region and by the rest of territorial collectives under the terms set forth in section L. 216-1 of the code of education.

The regional councils shall establish projects on higher education programmes and university research activities, where appropriate, under the proposal of the presidents of the University of Antilles-Guiana and the University of Réunion, depending on the priorities defined by them on the economic, social and cultural development.

The permission for this teaching and these activities shall be determined by the State, after receiving the opinion of the regional councils.

The regions of Guadeloupe, Guiana, Martinique and Réunion shall define the actions to be undertaken in cultural matters, after receiving the opinion or, where appropriate, based on the proposals of the territorial collectives and of the culture, education and environment council.

To this end, the regional council shall elaborate a regional cultural programme, especially in the fields of regional languages, literature and plastic, musical, and film arts.

Every concerned region will ensure the enhancement and development of the specific heritage of the region. [...]

Sub-article 3: Audiovisual communication

Every regional council of the regions of Guadeloupe, Guiana, Martinique and Réunion must be informed of the functioning and organisational conditions of the public service of the sound broadcasting and television in the region.

The president of the administration board of the company Réseau France Outre-mer shall submit, every year, to the regional council a report on its activity.

Section L4433-30

When the requests of authorisation regarding to the sound and television broadcasting services by radio relay channel or by cable, submitted to the audiovisual governing board (conseil supérieur de l'audiovisuel) under sections 29, 30 et 34 of the Law no. 86-1067 of 30 September 1986 on the freedom of communication, concern an overseas region, the audiovisual governing board (conseil supérieur de l'audiovisuel) shall consult beforehand the regional council of the concerned region.
